Lodging an Enduring Power of Attorney

There may be times when you need a trusted person to make decisions about your property on your behalf An enduring power of attorney is a legal document which allows you, the donor, to appoint someone to make financial and property decisions on your behalf

This person, the donee, becomes your attorney An enduring power of attorney can be used to assist in a variety of circumstances If you own a property you may wish to lodge your enduring power of attorney with Landgate so that your attorney's authority is recognized The enduring power of attorney forms and information kit are maintained by the Office of the Public Advocate and are available on the Landgate website If you are completing an enduring power If you are completing an enduring power of attorney and you have specific or complex issues it is recommended that you seek legal advice

As Landgate is required to permanently keep lodged documents We recommend that you create two identical originally signed documents and lodge both at the same time Landgate is unable to accept certified versions, the documents lodged must both be originals Landgate will be able to provide the second original back to you once your enduring power of attorney is registered This is known as a client original

It is not mandatory to lodge two original copies, and you can always purchase certified or non-certified copies from Landgate All you need is the unique document number provided to you on the receipt at the time of lodgement Enduring power of attorneys should be lodged at Landgate within three months of being prepared and signed, otherwise a statutory declaration will also be required You will also need to include a completed cover sheet which you can download from the Landgate website Lodgements can be made in person at Landgate's Midland or Perth offices, or by post

Anyone can lodge these documents Landgate refers to them as the lodging party Landgate will contact the lodging party if there are any issues during registration The fees to process your enduring power of attorney are paid at the time of lodgement Fee details are available on the Landgate website If lodging by post be sure to include a credit card authority form, a cheque or money order made payable to Landgate

If you're lodging in person Landgate can also accept cash and EFTPOS payments When you lodge your documents, you'll receive a receipt that includes your unique document number Once registered Landgate will post or hold your client original for collection The lodging party will need to provide a photo ID when collecting it from our office Landgate posts items using regular mail
